Terms of Service for The Pickle Co

1. Acceptance of Terms

By downloading, accessing, or using The Pickle Co mobile application or website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the app or website.

2. Description of Service

The Pickle Co app and website provide:

  • Court booking and reservation management
  • Pickleball lessons and coaching registration
  • Player matching and game coordination
  • Membership management and payment processing
  • Event registration and calendar features
  • Profile and account management

3. Eligibility

You must be at least 13 years old to use this app or website. By using our services, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

4.1 Account Creation

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access

4.2 Account Security

  • Choose a strong password
  • Do not share your account with others
  • We are not liable for losses from unauthorized account use

5. Membership Terms

5.1 Membership Types

  • Different membership tiers offer varying access levels to facilities and services
  • Membership details, pricing, and benefits are outlined in the app and website

5.2 Payment

  • Membership fees are processed through Stripe
  • Payments are non-refundable except as required by law
  • You authorize us to charge your payment method on file for recurring memberships
  • Failed payments may result in membership suspension

5.3 Cancellation

  • You may cancel your membership through the app or website settings
  • Cancellations take effect at the end of the current billing period
  • No refunds for partial months or unused services

6. Booking and Reservations

6.1 Court Bookings

  • Bookings are subject to availability
  • You must arrive within 15 minutes of your booking time or it may be forfeited
  • Late cancellations (less than 24 hours) may incur penalties

6.2 Lessons and Coaching

  • Lesson bookings are confirmed upon payment
  • Cancellations must be made at least 24 hours in advance for a refund
  • Coaches reserve the right to cancel due to emergencies or facility issues

6.3 No-Show Policy

  • Repeated no-shows may result in booking restrictions or account suspension
  • We reserve the right to charge no-show fees

7. Facility Rules and Safety

7.1 Liability Waiver

By using The Pickle Co facilities, you acknowledge that:

  • Pickleball involves physical activity and inherent risks
  • You participate at your own risk
  • You waive claims against The Pickle Co for injuries sustained during play
  • You are responsible for your own health and fitness to participate

7.2 Facility Conduct

You agree to:

  • Follow all facility rules and staff instructions
  • Respect other players and facility property
  • Use equipment properly
  • Report safety hazards immediately
  • Not engage in dangerous or inappropriate behavior

7.3 Assumption of Risk

You understand and assume all risks associated with pickleball, including but not limited to:

  • Physical injury from play
  • Equipment failure
  • Actions of other players
  • Facility conditions

8. User Conduct

You agree NOT to:

  • Violate any laws or regulations
  • Harass, abuse, or harm other users
  • Upload inappropriate content (photos, messages)
  • Attempt to hack or disrupt the app or website
  • Use our services for commercial purposes without permission
  • Create fake accounts or impersonate others
  • Spam or send unsolicited messages

9. Intellectual Property

9.1 Our Rights

  • The app and website, including all content, features, and functionality, are owned by The Pickle Co
  • Our trademarks, logos, and branding are protected
  • You may not copy, modify, or distribute our content without permission

9.2 User Content

  • You retain ownership of content you upload (photos, profile information)
  • By uploading content, you grant us a license to use it for app and website operations
  • You represent that you have rights to any content you upload

10. Privacy

Your use of the app and website is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

11. Payment and Refunds

11.1 Pricing

  • All prices are in the currency displayed in the app or website
  • Prices are subject to change with notice
  • Taxes may apply based on your location

11.2 Refund Policy

  • Membership fees are generally non-refundable
  • Service credits may be issued at our discretion
  • Refunds for lessons follow the cancellation policy (24-hour notice)

11.3 Billing Disputes

  • Contact us within 30 days of any billing issue
  • Provide documentation supporting your claim

12. Termination

12.1 Your Rights

  • You may delete your account at any time
  • Deletion does not relieve you of payment obligations

12.2 Our Rights

We may suspend or terminate your account if:

  • You violate these Terms
  • You engage in fraudulent activity
  • You threaten facility safety
  • Required by law

12.3 Effect of Termination

  • Access to the app and website will be disabled
  • Outstanding payments remain due
  • Certain provisions survive termination (liability, disputes, etc.)

13. Disclaimers

THE APP AND WEBSITE ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We do not guarantee:

  • Uninterrupted or error-free operation
  • Accuracy of information
  • Availability of courts or services
  • Results from using the app or website

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid in the past 12 months
  • This includes damages from: injuries, lost data, service interruptions, unauthorized access

15. Indemnification

You agree to indemnify and hold harmless The Pickle Co from claims arising from:

  • Your use of the app or website
  • Your violation of these Terms
  • Your violation of others' rights
  • Your use of the facilities

16. Dispute Resolution

16.1 Informal Resolution

18.3 No Waiver

Our failure to enforce a right does not waive that right.

18.4 Assignment

You may not transfer your rights under these Terms. We may assign our rights and obligations.
